Terms and conditions of sale and delivery - International
1 General
These terms of sale apply to the sale of goods and services on www.telmo.no to consumers.
Seller is: Telmo Control AS
The buyer is: The person listed as the buyer in the order - and is in the following text referred to as "you"(and similarly, designations such as "yours" are used).
www.telmo.no: The online store/platform associated with the domain www.telmo.no.
To make purchases on www.telmo.no, you must agree to the terms of this agreement and comply with them in full. The relevant terms of sale, together with your order and order confirmation, will constitute a collective contractual basis for the purchase.
If you are under the age of 18, you can only shop if you have your own debit card (debit card) that can be used for this. However, you may not use other payment methods that apply (see, for example, paragraph 4). You can also get a parent to do the trade for you.
We only deliver to mainland Norway and Svalbard, Sweden, Finland and Germany. www.telmo.no will charge for items with VAT.
Consumer purchases are governed by, among other things, the Consumer Purchase Act, the Right of Withdrawal, the Marketing Act, the Personal Data Act, the e-Commerce Act and the Credit Purchase Act. You can find these laws on https://lovdata.no/.
2 Order
Your order is binding when your order is registered with us. We are at the same time bound by your order if this does not deviate from what is offered by us in our webshop, our marketing or otherwise. However, you have the right to cancel your purchase under the Right of Withdrawal Act, see section 6 of the agreement.
We reserve the right to cancel your order or any part of it, if the product is sold out. If sold-out, you will be notified of this by email, possibly along with information about what we can offer instead.
www.telmo.no will send an order confirmation when the order is placed. You will receive a delivery confirmation when the items are shipped. Your receipts will be delivered to you by email and they will be transferred to "my page/order history", showing the estimated delivery date, the default payment method selected.
3 Prices
All prices include VAT. The total cost of the purchase will be stated before the completion of an order and include all costs associated with the purchase such as costs of shipping, packaging, customs, etc.
If you purchase goods from www.telmo.no and enter delivery to places where no VAT is due, then prices will still include VAT. Contact us before you order in such cases and we will help you find the right way to shop with us.
Prices are constantly changing and until the completion of each purchase, prices can go up or down, as a result of changes in prices from our suppliers or currency changes. But you should of course be sure that the price you have paid is what applies! Any price changes that occur after an order is placed will not be retroactive.
We reserve the right to any price deviations, delivery defects, sold-out goods, printing errors, etc. due to human and technical errors caused by, for example, currency changes, tax changes, natural disasters, etc. In the event that there have been printouts or printing errors of significant size from Telmo Control in advertising and/or in general presentations and/or in online stores that deviate more than 15% of the normal retail price, www.telmo.no may unilaterally remove or reject orders. However, these errors must be corrected within a reasonable time after the error has been detected (it should be said that this has only happened at 1 point when there was a fault on our website).
4 Payment
The purchase price can be redeemed by bank or credit card, invoice or purchase financing of your choice at check-out. We cooperate with Klarna Bank AB as our payment processor.
If you choose invoice or purchase financing from Klarna Bank AB and this is granted, Klarna Bank AB will in such cases handle the purchase price against us as a seller on your behalf, and you will settle with Klarna Bank AB in accordance with the terms of the selected Financing Solution. You can check the status of your payment on www.klarna.se or in the Klarna app.
When using a payment card, the purchase price will be reserved on the card upon booking after the check-out has ended. The card will be charged on the day of the broadcast. Unclaimed packages will be charged a fee of SEK 250/NOK 250/EUR 25 + shipping/return of the current order to cover our expenses.
5 Delivery
All general delivery times indicated on the www.telmo.no must be considered indicative. When the delivery time is specified in number of days, the days of the week and the delivery time are always in addition. If the inventory status is green, all items on www.telmo.no are in stock at Skedsmo outside Oslo, Norway.
As Norway is not in the EU, we normally ship 2 times per week from our warehouse to Sweden/Finland/Germany and possibly other countries. Calculate approx. 5 – 10 days delivery time. In high season, it should be estimated 1-2 days extra for delivery, although this is of course something we try to avoid at all costs.
If delivery of the products is delayed, Telmo Control AS will provide you with information as soon as we have knowledge of it, together with information about and if necessary, when the delivery can take place, or if the product is sold out.
Telmo Control is responsible for the products until they are taken over by you, i.e. once you have received the products in your possession.
6 Right of withdrawal
Of course, you have the right of withdrawal when shopping at www.telmo.no. The right of withdrawal requires that you notify the seller Telmo Control within 14 days of receipt of the delivery that you regret the purchase (cancellation period).

In order for the right of withdrawal to apply, the product must be returned to the seller in the same quantity and condition as you received it. If you use or examine the goods in a way that goes beyond what is necessary to determine the nature, characteristics and function of the goods, and this means that the goods are reduced in value, the seller may deduct an amount equal to the value reduction in the purchase price.
All products to be returned to the seller using the right of withdrawal must be submitted within 1 month. The buyer pay the return postage/transport and carry the risk until the goods come back to the seller.
The seller is obliged to pay back to you what you have paid for the item. If the seller has delivered the wrong goods or is otherwise responsible for the buyer regretting the purchase, the seller must also pay back the shipping costs. Otherwise, you carry the shipping expenses.
PS! This only applies when the entire purchase is returned. If you have explicitly chosen a particular shipping in addition to what is necessary to carry the item, it shall be paid for by you.
Refunds shall be made within 14 days of receipt of the undo notice by the seller, but still not until 2 days after the seller receives the goods back from you. Refunds will be made to the customer through the payment method used by the customer when ordering, unless otherwise agreed. Normally, the refund is made through Klarna Bank AB's customer portal.
The right of withdrawal does not apply unless otherwise provided for by law.
7 Delayed delivery
If the seller does not deliver the goods, or delivers it too late under the contract, and this is not due to you or anything for which you are responsible, you may, in accordance with the rules of chapter 5 of the Consumer Purchase Act, hold the purchase price back, terminate the contract or claim damages from the seller.
If the seller's return is delayed for more than 10 days, you have the right to request a replacement item on behalf of the seller. The seller shall not make more than two attempts at rectification or re-delivery for the same deficiency.
8 Complaints and warranties
Once you have received your products, you should check if the delivery is in accordance with your shipping confirmation. Check if the products have been damaged during transport or if the products are otherwise defective or missing.
If an error or defect in an item you have purchased on www.telmo.no is detected, you must, within a reasonable time after discovering, or should have discovered it, notify the seller that you will be invoking the error (claims). Complaints must be made no later than two years after the shipment has arrived at you. If the product or any part of it is intended to last significantly longer, the last time limit is to promote five years. If you do not notify on time, the right to claim the defect will be lost.
For the purpose of proof, we recommend that the complaint be submitted to the seller in writing, primarily by contacting the seller by email postmaster@telmo.no and referring to the order you wish to return (or linking other complaints to).
You will then receive a confirmation from Telmo Control that we have received your complaint incl. a case number, which will come to the address or email address you are sending from.
If there is a shortage of the goods and this is not due to you or something you are responsible for, and you have notified us within the above mentioned deadlines, you can comply with the rules of the Consumer Sales Act Chapter 6:
1. Get all or part of the purchase price back
2. Under certain assumptions choose between correction or redelivery
3. Under certain conditions, a price reduction
4. Subject to certain conditions, claim compensation
If there is no shortage of the goods you have returned, the seller may only claim payment for investigations that have been necessary to determine if there is a defect and payment for the repair of the goods, if we have expressly stated that you must cover such costs, consumer law Section 30.
If you take action on your own initiative to remedy the error beyond what may have been agreed with the seller, the seller will not pay these costs.
The seller reserves the right to refuse a claim if it is found that the product has no shortage under applicable consumer law. By complaining, the merchant follows the guidelines provided by consumer dispute council.
The seller can repair an item 2 times for the same error. In the event of the same error 3 times, the buyer can claim money back.
The warranty for goods covers only original manufacturing defects that are faulty in accordance with applicable consumer law, not defects arising during or after a change in the operation and appearance of the object, such as the conversion, upgrade and configuration of the product. The customer's receipt is valid as a guarantee certificate. The seller is responsible for return shipping for approved complaints.
Our warranties do not constitute a limitation of the Warranty Period for goods under the Consumer Sales Act.
9 Payment by credit card
We do not store card numbers beyond what is necessary to ensure effective handling of any problems with load, cancellation of booking and crediting.
To make it easier to shop with us next time, you can, when paying at checkout, choose to securely store your card details with us. It is important that you sign out of your customer account after you complete the purchase on www.telmo.no. You are solely responsible for not sharing your username and password with others. To make the payment, we will only disclose your information to our payment provider Klarna Bank AB, they will keep the information in a safe and accurate manner and are certified by PSI Level 1.
10 Newsletters and communication
We offer newsletters by e-mail with different types of information and offers. It is optional to receive these and you must explicitly register for the promotion or registration on the www.telmo.no. It is also easy to sign up for the newsletter from the website or by clicking on a link at the bottom of the newsletter.
If your trade is interrupted, we will send you an email with a reminder of the products you put in your shopping cart. We do this as an extra customer service to make the shopping experience with us as smooth and easy as possible.
The price and availability of the products in the email is based on the time you added them to the shopping cart. Please note that prices may change during different promotions with expiration dates. The products may also be sold out.
We also send out order and shipping documents, surveys and Follow-up emails related to purchases made with us.
11 Privacy/GDPR policy

12 Sales security
Telmo control which, unless otherwise agreed, has sales security in delivered products as collateral for the purchase price, including interest and costs, until these are paid in full, cf. Reverse team section 3-14 FLG.
13 Customer duties
The person registered as a customer of www.telmo.no is responsible for the payment of the benefits www.telmo.no provide in accordance with the relevant terms and conditions. The liability also includes the use of the customer's access, including the use of the individual, unless it is demonstrated that the use of the individual is made possible by negligence of www. Telmo. no's part.
14 Exceptional circumstances
The seller is only responsible for loss of the value for the item, if it has been found to be incorrect or missing. However, this does not apply if the defect is due to circumstances beyond our control and that we cannot reasonably be expected to avoid or overcome the consequences of the defect.
The Seller is not liable for indirect losses due to defects if the loss is caused by gross negligence or caused by the seller's side.

15 Amendment of the terms and conditions
We reserve the right to change other conditions, also as a result of changes in legislation.
16 Force Majeur
Are we prohibited from providing or making mandatory re-delivery, or becoming such a delivery obligation unreasonably burdensome as a result of a conflict at work or any other circumstance when the parties are unable to control it, such as in the case of fire, war, mobilisation or unforeseen military representations of a similar magnitude, requisition, seizures, currency restrictions, rebellion and dissolution, lack of means of transport, general shortage of raw materials, restriction of fuel supply , as well as defects in or delays in deliveries of subcontractors or manufacturers arising from circumstances covered by this clause, traders are exempt from any liability other than in the event of a complaint and credit it to the defective item associated with the purchase price.
17 Disputes and applicable law
Disputes in connection with the terms and related provisions, as well as disputes concerning trading on www.telmo.no, comply with Norwegian law and are subject to the ordinary dispute resolution body and courts, with oslo tingrett as the place for all the consideration of the district court.
